Indemnity Declaration

I declare, confirm and agree as follows:

I have read the Rules and Regulations and the terms and conditions of entry and participation (https://lukenyauniversity.ac.ke/lukenya/physical-terms-and-conditions/) and agree to participate on the understanding that I will adhere to all the provisions stated therein for the event entered.
Assumption of Risk –I understand and acknowledge that by signing and/or submitting an entry application form and participating in the Lukenya University Marathon (event) whether one or more of the Full Marathon, Half Marathon and/or any related event activities may involve real risks including but not limited to serious injury or even death from various causes including over exertion, dehydration and accidents with other participants, spectators or road users. I voluntarily assume all risks associated with my entry application and participation in the Event or any activity associated with it even if the Event may be regulated/ policed.
Medical Fitness –I certify that I am physically fit and have sufficiently trained up to appropriate levels of fitness for participation in the event and I understand that it is my responsibility to consult with a physician prior to participating if I have any concerns about my medical condition.
Medical Treatment Consent –I consent to receiving any medical treatment that event organizers think necessary during or after the event. If I am injured or taken ill or otherwise suffer any detriment whatsoever, I hereby irrevocably authorize the event organizers and officials to transport me to a medical facility and/ or to administer emergency medical treatment and I waive all claims that might result from such transport and/or treatment or delay or deficiency therein. I shall repay or reimburse any of my medical and emergency expenses and I hereby authorize you to incur the same. I shall provide to event officials such medical data relating to me as they may request. I agree that nothing herein shall oblige the event officials or organizers or any other person to incur any expenses or to provide any transport or treatment.
Release & Indemnification –I, for myself and my legal representatives, in consideration of and as a condition of acceptance of my entry in the Event for myself, my executors, administrators, heirs, next of kin, successors and assigns, release the event organizer-Lukenya University, officers, its agents, affiliates, employees, members, volunteers, sponsors, promoters and any person or other body directly or indirectly associated with the Event, from all claims, demands and proceedings arising out of or in connection with my participation in the Event and I indemnify them against all liability (including acts of negligence to the fullest extent permitted by law) whatsoever and howsoever caused arising as a result of or in connection with my participation in the event including any loss whatsoever of personal property or otherwise.
Media Release –The event organizer collects information and/or personal data including but not limited to contact information, motion pictures, recordings or any other records of this event from all participants and reserves the right to share this information with third parties as a condition of entry into the event. I grant permission and consent to my details being disclosed to third parties necessary in the conduct of the event, medical officials during treatment and other stakeholders of the event. I consent to the publication and/or use in any form of media whatsoever of my name, image, voice, results, statements or otherwise, without payment or compensation and agree that I will reasonably expect to receive marketing material, such as SMS, email and entry forms, from event organizer or its appointed agents/officials regarding its events.
Agreement to Follow Rules –I will abide by the event rules and timelines, as varied from time to time and will abide by directions given by event organizer and accept the event organizer has discretion to accept or decline an entry on whatever grounds.
Non-refund –I acknowledge that I am not (and no other person is) entitled to a refund or credit of any nature in relation to the entry fee(s) I have paid (for myself or another person), for any reason whatsoever, or in any circumstances, unless and to the extent that the event organizer is required to provide a refund or payment at law. I acknowledge that the event organizer is entitled to deduct administrative, legal, operational and other costs from any amount (if any) I would be entitled to receive by way of refund (if payable at law). I accept the event organizer may at their absolute discretion, limit the number of entries in an event for risk management purposes. Should my entry be received and rejected after an introduced limit has been reached, I shall be entitled to a full refund of my entry fees only and have no other claims.
Application of Terms & Conditions –I acknowledge that the terms and conditions of Entry and participation and the clauses of the indemnity apply to all members of a group on whose behalf I am signing.
Minors –If I have under my care or control children below 18 years of age participating in the event, then I shall ensure that they are accompanied at all times by a responsible adult and understand that the terms and conditions of entry and participation and the clauses of the indemnity apply to such children. The parents or guardians will take full responsibility and liability for the minors participating in the event.
Acknowledgment of Rules and Regulations –I acknowledge that I have read and understand all rules and regulations governing the event, and I agree to comply with them. I further acknowledge that I have read this indemnity declaration form carefully and that I understand its contents. I am aware that by electronically submitting this form, I agree and confirm that I accept all terms and conditions, and waiver policy.
